My Job Is Offering Me $5000 Dollars & Unemployment But To Sign Off Not To Sue?

Postby Kieron » Sat Aug 19, 2017 11:39 pm

I have worked at the company for roughly 6 months and 2 weeks. I made $18.30 including my shift premium of 60 cents. Now it seems a little weird that they would offer so much for such little working time at the company. I have never dealt with a severance check before either so that could be my outlook. Does that seem to you that the company knows something that i do not and is trying to sell me to not sue and get more?

Yes.
Something is fishy.
They are probably conducting some kind of illegal business.
I say, take the money.

find out what it is, also since they are offering you that much, they seem to be doing something unethical so i would say take the money and leave the company and not get involve in anything they are planning to do.

Did you bother asking them what they don't want you to sue for?

sounds like they are going to go under, I'd take the deal because if the do go under all you get is the unemployment, if they fire you, you get nothing

Most severance packages come with a time limit cut off.
Yours was probably six months.

The request to not sue is standard.
It doesn't have to be so dramatic.
Read the document to make sure there isn't a clause about asbestos poisoning, otherwise it's just so you can't sue for your employment back.

Bottom line is, unless you know that they are doing something illegal or that you have, once you have your cash and no longer work there, I can't think of a reason that you would be tied to the company.

Thank your lucky stars and start looking for a new job.

I also have to point out that $5K in this climate isn't really a lot.
You were making fairly decent money and may be without a job, on unemployment, for two years.
When you separate the money to supplement your monthly unemployment, it's probably not really that long.

EDIT: Ah.
Well, even though NY employers may fire you at any time, that doesn't mean you couldn't sue for wrongful termination.
It's probably easier to just write you, and the rest of the people involved, off.
Check to make sure that your job record will not have an odd mark somehow.
Make them spell out that it won't be a problem at your next job.

Still take the money.
You've only been there six months.
Run!

We need a lot more details in order to figure out what is going on.
However, do not sign anything without reading it over thoroughly.
Ask a lawyer if you don't understand something.
Don't let them pressure you into signing on the spot.

The Company is trying to let me go over supervisors giving out false information and writing up employees (me included in this) and than firing employees. The only difference is i have a little bit more understanding and interest in things and dug up things to keep my job. So it put me in a situation of them targeting me. They just came out of no wheres with the offer thats what strikes me. I live in new york and its an at will state meaning any employer can fire you at any time without any reason. so they do not have to offer me any money legally but they are?
