Legally Can My Part Time Job Fire Me?

I'm still in my 90 day probational period but 2 weeks ago I was diagnosed with Leukemia and started chemo right away. Well I've missed 2 days so far and I'm afraid my boss will fire me. I have a full time job also, but I would really like to hang on to this job to pay for what my health insurance doesn't. I'm not gonna sue if they fire me, I'd just like to know if it's possible.

convinced, if you're an at-will worker (one with out a freelance or union). There are, besides the indisputable fact that, whistle-blower statutes which could seem after you from retaliation in case you suggested, or threatened to record, the criminality.

Yes your part time employer can legally fire you for missing work due to your Leukemia diagnosis. At-will employment is a doctrine of American law that defines an employment relationship in which either party can break the relationship with no liability, provided there was no express contract for a definite term governing the employment relationship and that the employer does not belong to a collective bargaining group (i.e., has not recognized a union). Under this legal doctrine:

?any hiring is presumed to be "at will"; that is, the employer is free to discharge individuals "for good cause, or bad cause, or no cause at all," and the employee is equally free to quit, strike, or otherwise cease work.

Attendance is critical to any job. If you cannot report to work when scheduled, your employer is free to fire you and replace you with someone else. You would have nothing to sue for.

Im sorry to hear about your diagnosis. Im not sure what you do, but better to speak with your boss. I think most states are at-will, meaning they can terminate you at their discretion. However I hope you recover and keep your job.

You can be fired for no reason at all if you're on probation. They are totally within their legal rights to fire you. Not too many people would want to fire someone because they have to go to chemo, although financially or for business reasons, they may have no choice if they really need you there on a reliable basis. Sorry about the cancer.... I know you need the money, but your health would probably be best served if you're not working 2 jobs while going through treatment...
